Media Release and License

By completing this form and sending media to Fire Islands, I agree to the following. “Fire Islands” means Fire Islands LLC, its affiliates including Aluminum Outdoor Kitchens LLC, and their employees, contractors, successors and assigns.

1. Who I am

I am at least 18 years old, and I am the customer or an adult member of the customer's household on the Fire Islands order below.

2. The exchange

I understand this is the Founding 25 offer: I send video of my delivery, the setup and the first cook, and Fire Islands sends me a box of Omaha Steaks. The steaks are for the footage and not for a favorable opinion. Fire Islands has asked me to say what I actually think and to film any problems, and the box ships either way. Fire Islands does not have to use anything I send.

2a. First come, first served

I understand the Founding 25 is limited to twenty five outdoor kitchens, that places are first come and first served, and that my place is decided by when my footage reaches Fire Islands and not by when I ordered, when I signed this, or when my kitchen was delivered. If the twenty five are already taken when my footage arrives, Fire Islands will tell me, my footage may still be used under this agreement, and no box of steaks is owed. Any count shown on the Fire Islands website is a guide, not a reservation.

3. What I am sending

For everything I send, I confirm that I made it myself or have the right to give it to Fire Islands for the uses below; that everyone who appears or is heard in it has agreed to those uses; and that I have the right to hand over any music, artwork or signage caught in it, or that Fire Islands may remove it.

4. The license

I grant Fire Islands a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, transferable and sublicensable license to reproduce, distribute, display, perform, edit, cut, crop, retouch, reformat, caption, add music to, combine with other material, and otherwise use what I send, in whole or in part, in any medium now existing or invented later.

This expressly includes paid advertising, on Facebook, Instagram, YouTube, TikTok and Google among others, as well as the Fire Islands website, email, social accounts, printed material, trade show displays, dealer material and press. Advertising platforms require Fire Islands to grant them a sublicense to host and deliver this material, and I consent to that.

5. My name and likeness

Fire Islands may use my first name, the first names of household members who appear, and my city and state alongside the material. Fire Islands will not publish my street address, phone number or email address. Fire Islands may use my full name only with my separate written agreement.

6. Anyone under 18

If anyone under 18 appears or is heard in what I send, I confirm I am that person's parent or legal guardian, or that I have their parent's or legal guardian's consent, and I give consent on their behalf to everything here.

7. Other adults

If any other adult appears or is heard in what I send, I confirm I have told them how Fire Islands will use it, including in paid advertising, and that they agreed.

8. My property

I confirm I am the owner or lawful occupant of the property shown and I consent to images of it being used as described. Separately, if Fire Islands or someone working for it visits my property by arrangement to photograph or film, this consent covers that material too, and I may ask them to stop recording at any time while they are on my property.

9. No further payment

Beyond the box of steaks in Section 2, I will not be paid, and I am not an employee, contractor or agent of Fire Islands.

10. Approval and claims

I waive any right to inspect or approve the finished material, and so far as the law allows I release Fire Islands from any claim arising out of the uses described here, including claims for invasion of privacy, right of publicity, defamation or false light.

11. Taking it down

I may ask Fire Islands to stop using specific material by writing to info@fireislands.com. Fire Islands will stop using it in anything it controls within a reasonable time and will make reasonable efforts to pull it from live advertising. Fire Islands does not have to recall printed material already distributed, or material already republished by somebody else.

12. Everything else

This is the whole agreement on this subject. Florida law governs it, venue in Citrus County. If part of it is unenforceable the rest stands. It binds my heirs and assigns.
